De\u011fi\u015ftirmeden aktar\u0131yorum:<\/div>\n<div dir=\"ltr\">i) 1-Anayasam\u0131zda cumhuriyetin temel nitelikleri aras\u0131nda yer alan ve yine anayasan\u0131n 4&#8217;\u00fcnc\u00fc maddesi ile teminat alt\u0131na al\u0131nan laiklik ilkesi b\u00fcy\u00fck bir titizlik ve hassasiyetle korunmal\u0131, bunun korunmas\u0131 i\u00e7in mevcut yasalar hi\u00e7bir ayr\u0131m g\u00f6zetmeksizin uygulanmal\u0131, mevcut yasalar uygulamada yetersiz g\u00f6r\u00fcl\u00fcyorsa yeni d\u00fczenlemeler yap\u0131lmal\u0131d\u0131r.<\/div>\n<div dir=\"ltr\">ii) 2-Tarikatlarla ba\u011flant\u0131l\u0131 \u00f6zel yurt, vak\u0131f ve okullar, devletin yetkili organlar\u0131nca denetim alt\u0131na al\u0131narak Tevhid-i Tedrisat Kanunu gere\u011fi Milli E\u011fitim Bakanl\u0131\u011f\u0131&#8217;na devri sa\u011flanmal\u0131d\u0131r.<\/div>\n<div dir=\"ltr\">iii) 3-Gen\u00e7 nesillerin k\u00f6rpe dima\u011flar\u0131n\u0131n \u00f6ncelikle cumhuriyet, Atat\u00fcrk, vatan ve millet sevgisi, T\u00fcrk milletini \u00e7a\u011fda\u015f uygarl\u0131k d\u00fczeyine \u00e7\u0131karma \u00fclk\u00fc ve amac\u0131 do\u011frultusunda bilin\u00e7lendirilmesi ve \u00e7e\u015fitli mihraklar\u0131n etkisinden korunmas\u0131 bak\u0131m\u0131ndan:<\/div>\n<div dir=\"ltr\">a-8 y\u0131ll\u0131k kesintisiz e\u011fitim, t\u00fcm yurtta uygulamaya konulmal\u0131.<\/div>\n<div dir=\"ltr\">b-Temel e\u011fitimi alm\u0131\u015f \u00e7ocuklar\u0131n, ailelerinin iste\u011fine ba\u011fl\u0131 olarak, devam edebilece\u011fi ?Kuran kurslar\u0131n\u0131n Milli E\u011fitim Bakanl\u0131\u011f\u0131 sorumlulu\u011fu ve kontrol\u00fcnde faaliyet g\u00f6stermeleri i\u00e7in gerekli idari ve yasal d\u00fczenlemeler yap\u0131lmal\u0131d\u0131r.<\/div>\n<div dir=\"ltr\">1<\/div>\n<div dir=\"ltr\">iv) -Cumhuriyet rejimine ve Atat\u00fcrk ilke ve ink\u0131laplar\u0131na sad\u0131k, ayd\u0131n din adamlar\u0131 yeti\u015ftirmekle y\u00fck\u00fcml\u00fc, milli e\u011fitim kurulu\u015flar\u0131m\u0131z, Tevhid-i Tedrisat Kanunu&#8217;nun \u00f6z\u00fcne uygun ihtiya\u00e7 d\u00fczeyinde tutulmal\u0131d\u0131r.<\/div>\n<div dir=\"ltr\">v) 5-Yurdun \u00e7e\u015fitli yerlerinde yap\u0131lan dini tesisler belli \u00e7evrelere mesaj vermek amac\u0131yla g\u00fcndemde tutularak siyasi istismar konusu yap\u0131lmamal\u0131, bu tesislere ihtiya\u00e7 varsa, bunlar Diyanet \u0130\u015fleri Ba\u015fkanl\u0131\u011f\u0131&#8217;nca incelenerek mahalli y\u00f6netimler ve ilgili makamlar aras\u0131nda koordine edilerek ger\u00e7ekle\u015ftirilmelidir.<\/div>\n<div dir=\"ltr\">vi) 6-Mevcudiyetleri 677 say\u0131l\u0131 yasa ile men edilmi\u015f tarikatlar\u0131n ve bu kanunda belirtilen t\u00fcm unsurlar\u0131n faaliyetlerine son verilmeli, toplumun demokratik, siyasi ve sosyal hukuk d\u00fczeninin zedelenmesi \u00f6nlenmelidir.<\/div>\n<div dir=\"ltr\">vii) 7-\u0130rticai faaliyetleri nedeniyle Y\u00fcksek Askeri \u015eura kararlar\u0131 ile T\u00fcrk Silahl\u0131 Kuvvetleri&#8217;nden (TSK) ili\u015fkileri kesilen personel konusu istismar edilerek TSK&#8217;yi dine kar\u015f\u0131ym\u0131\u015f gibi g\u00f6stermeye \u00e7al\u0131\u015fan baz\u0131 medya gruplar\u0131n\u0131n silahl\u0131 kuvvetler ve mensuplar\u0131 aleyhindeki yay\u0131nlar\u0131 kontrol alt\u0131na al\u0131nmal\u0131d\u0131r.<\/div>\n<div dir=\"ltr\">viii) 8- \u0130rticai faaliyetleri, disiplinsizlikleri veya yasad\u0131\u015f\u0131 \u00f6rg\u00fctlerle irtibatlar\u0131 nedeniyle TSK&#8217;dan ili\u015fkileri kesilen personelin di\u011fer kamu kurum ve kurulu\u015flar\u0131nda istihdam\u0131 ile te\u015fvik unsuruna imkan verilmemelidir.<\/div>\n<div dir=\"ltr\">ix) 9- TSK&#8217;ya a\u015f\u0131r\u0131 dinci kesimden s\u0131zmalar\u0131 \u00f6nlemek i\u00e7in mevcut mevzuat \u00e7er\u00e7evesinde al\u0131nan tedbirler; di\u011fer kamu kurum ve kurulu\u015flar\u0131, \u00f6zellikle \u00fcniversite ve di\u011fer e\u011fitim kurumlar\u0131 ile b\u00fcrokrasinin her kademesinde ve yarg\u0131 kurulu\u015flar\u0131nda da uygulanmal\u0131d\u0131r.<\/div>\n<div dir=\"ltr\">x) 10-Bu maddenin tam metnini T\u00fcrkiye&#8217;nin uluslararas\u0131 ili\u015fkilerini ilgilendirdi\u011fi i\u00e7in yay\u0131nlayam\u0131yoruz.<\/div>\n<div dir=\"ltr\">xi) 11-A\u015f\u0131r\u0131 dinci kesimin T\u00fcrkiye&#8217;de mezhep ayr\u0131l\u0131klar\u0131n\u0131 k\u00f6r\u00fcklemek suretiyle toplumda kutupla\u015fmalara neden olacak ve dolay\u0131s\u0131yla milletimizin d\u00fc\u015fmanca kamplara ayr\u0131lmas\u0131na yol a\u00e7acak \u00e7ok tehlikeli faaliyetler yasal ve idari yollarla mutlaka \u00f6nlenmelidir.<\/div>\n<div dir=\"ltr\">xii) 12-T.C. Anayasas\u0131, Siyasi Partiler Yasas\u0131, T\u00fcrk Ceza Yasas\u0131 ve bilhassa Belediyeler Yasas\u0131&#8217;na ayk\u0131r\u0131 olarak sergilenen olaylar\u0131n sorumlular\u0131 hakk\u0131nda gerekli yasal ve idari i\u015flemler k\u0131sa zamanda sonu\u00e7land\u0131r\u0131lmal\u0131 ve bu t\u00fcr olaylar\u0131n tekrarlanmamas\u0131 i\u00e7in her kademede kesin \u00f6nlemler al\u0131nmal\u0131d\u0131r.<\/div>\n<div dir=\"ltr\">xiii) 13-K\u0131yafetle ilgili kanuna ayk\u0131r\u0131 olarak ortaya \u00e7\u0131kan ve T\u00fcrkiye&#8217;yi \u00e7a\u011fd\u0131\u015f\u0131 bir g\u00f6r\u00fcn\u00fcme y\u00f6neltecek uygulamalara mani olunmal\u0131, bu konudaki kanun ve Anayasa Mahkemesi kararlar\u0131 taviz verilmeden \u00f6ncelikle ve \u00f6zellikle kamu kurum ve kurulu\u015flar\u0131nda titizlikle uygulanmal\u0131d\u0131r.<\/div>\n<div dir=\"ltr\">xiv) 14-\u00c7e\u015fitli nedenlerle verilen, k\u0131sa ve uzun namlulu silahlara ait ruhsat i\u015flemleri polis ve jandarma b\u00f6lgeleri esas al\u0131narak yeniden d\u00fczenlenmeli, bu konuda k\u0131s\u0131tlamalar getirilmeli, \u00f6zellikle pompal\u0131 t\u00fcfeklere olan talep dikkatle de\u011ferlendirilmelidir.<\/div>\n<div dir=\"ltr\">xv) 15-Kurban derilerinin, mali kaynak sa\u011flamay\u0131 ama\u00e7layan ve denetimden uzak rejim aleyhtari \u00f6rg\u00fct ve kurulu\u015flar taraf\u0131ndan toplanmas\u0131na mani olunmal\u0131, kanunla verilmi\u015f yetki d\u0131\u015f\u0131nda kurban derisi toplatt\u0131r\u0131lmamal\u0131d\u0131r.<\/div>\n<div dir=\"ltr\">xvi) 16-\u00d6zel \u00fcniforma giydirilmi\u015f korumalar ve buna neden olan sorumlular hakk\u0131nda yasal i\u015flemler ivedilikle sonu\u00e7land\u0131r\u0131lmal\u0131 ve bu t\u00fcr yasad\u0131\u015f\u0131 uygulamalar\u0131n ula\u015fabilece\u011fi vahim boyutlar dikkate al\u0131narak, yasa ile \u00f6ng\u00f6r\u00fclmemi\u015f b\u00fct\u00fcn \u00f6zel korumalar kald\u0131r\u0131lmal\u0131d\u0131r.<\/div>\n<div dir=\"ltr\">2<\/div>\n<div dir=\"ltr\">xvii) 17-\u00dclke sorunlar\u0131n\u0131n \u00e7\u00f6z\u00fcm\u00fcn\u00fc &#8220;Millet kavram\u0131 yerine \u00fcmmet kavram\u0131&#8221; baz\u0131nda ele alarak sonu\u00e7land\u0131rmay\u0131 ama\u00e7layan ve b\u00f6l\u00fcc\u00fc ter\u00f6r \u00f6rg\u00fct\u00fcne de ayn\u0131 bazda yakla\u015farak onlar\u0131 cesaretlendiren giri\u015fimler yasal ve idari yollardan \u00f6nlenmelidir.<\/div>\n<div dir=\"ltr\">xviii) 18-B\u00fcy\u00fck Kurtar\u0131c\u0131 Atat\u00fcrk&#8217;e kar\u015f\u0131 yap\u0131lan sayg\u0131s\u0131zl\u0131klar ve Atat\u00fcrk aleyhine i\u015flenen su\u00e7lar hakk\u0131ndaki 5816 say\u0131l\u0131 kanunun istismar edilmesine f\u0131rsat verilmemelidir.<\/div>\n<div dir=\"ltr\"><\/div>\n<div dir=\"ltr\">28 \u015eubat Kararlar\u0131 denildi\u011finde, akla ilk gelen \u201ckamusal alanda \u00f6rt\u00fcnmenin inan\u00e7 kurallar\u0131na dayal\u0131 k\u0131l\u0131nmas\u0131n\u0131n yasaklanmas\u0131\u201d olmaktad\u0131r.<\/div>\n<div dir=\"ltr\">Oysa ki, 28 \u015eubat Karar say\u0131s\u0131 18 olup, \u00f6rt\u00fcnme ile ilgili d\u00fczenleme, on\u00fc\u00e7\u00fcnc\u00fc s\u0131rada yer almaktad\u0131r. Ve bu yanl\u0131\u015ftan yola \u00e7\u0131karak, siyasal \u0130slamc\u0131lar\u0131n(\u015feriat d\u00fczenini kuralla\u015ft\u0131rmak isteyenler) dinmeyen ve gerekti\u011finde k\u00f6p\u00fcrt\u00fclen laik Cumhuriyet d\u00fc\u015fmanl\u0131\u011f\u0131n\u0131n arac\u0131 olarak kullan\u0131lmaktad\u0131r.<\/div>\n<div dir=\"ltr\">Oysa, 28 \u015eubat Kararlar\u0131 i\u00e7inde, b\u00f6yle bir yasaklama karar\u0131 yoktur. Uygulanmas\u0131 istenilen Anayasa Mahkemesi (AYM)\u2019nin; 2547 Say\u0131l\u0131 Y\u00fcksek\u00f6\u011fretim Yasas\u0131na \u201cEK Madde 16\u201d olarak eklenen \u201cY\u00fcksek\u00f6\u011fretim kurumlar\u0131nda, dershane, laboratuar, klinik, poliklinik ve koridorlar\u0131nda \u00e7a\u011fda\u015f k\u0131yafet ve g\u00f6r\u00fcn\u00fcmde bulunmak zorunludur.<\/div>\n<div dir=\"ltr\">Dini inan\u00e7 sebebiyle boyun ve sa\u00e7lar\u0131n \u00f6rt\u00fc veya t\u00fcrbanla kapat\u0131lmas\u0131 serbesttir\u201d h\u00fckm\u00fcn\u00fcn; dinsel inanca dayal\u0131 hukuk kural\u0131 konulamayaca\u011f\u0131, bu d\u00fczenlemenin Anayasa&#8217;n\u0131n Ba\u015flang\u0131\u00e7, 2, 10, 24, 174. maddelerine ayk\u0131r\u0131l\u0131\u011f\u0131 gerek\u00e7esiyle iptal\u201d kararlar\u0131d\u0131r. AYM 07.03.1989,1989\/1-12, ve 09.04.1991 tarih 1990\/36\u20131991\/8).<\/div>\n<div dir=\"ltr\"><\/div>\n<div dir=\"ltr\">G\u00fcn\u00fcm\u00fczde de ge\u00e7erli olan AYM Kararlar\u0131n\u0131n gerek\u00e7eleri, korunmak istenenin ne oldu\u011funu ve ya\u015famsall\u0131\u011f\u0131n\u0131 burada an\u0131msaman\u0131n yararl\u0131 olaca\u011f\u0131n\u0131 d\u00fc\u015f\u00fcn\u00fcyorum:<\/div>\n<div dir=\"ltr\">\u201c\u2026Dini inan\u00e7 sebebiyle..&#8221; ibaresini ta\u015f\u0131d\u0131\u011f\u0131ndan demokratiklik ilkesine ters d\u00fc\u015fmektedir. Ulusal egemenlik kavram\u0131, demokratik yap\u0131n\u0131n temelidir. Demokratik d\u00fczen ise, dinsel gerekleri egemen k\u0131lmay\u0131 ama\u00e7layan \u015feriat d\u00fczeninin kar\u015f\u0131t\u0131d\u0131r. Dinsel gereklere y\u00f6netimde a\u011f\u0131rl\u0131k veren bir d\u00fczenleme demokratik olamaz. Demokratik devlet, ancak laik devlettir. Dinsel gerekli d\u00fczenlemeler dinsel \u00e7abalar\u0131, zorlamalar\u0131, bunlar da dinsel ayr\u0131l\u0131klar\u0131 getirir. Sonu\u00e7ta demokrasinin \u00f6zg\u00fcrl\u00fck\u00e7\u00fc, \u00e7o\u011fulcu, ho\u015fg\u00f6r\u00fcl\u00fc niteli\u011fi kalmaz&#8221;.<\/div>\n<div dir=\"ltr\">Bu karar ve gerek\u00e7esi ile, g\u00fcn\u00fcm\u00fczdeki inanc\u0131n bir mezhebinin uygulama bulmas\u0131 ve giderek kimi kamusal alanlarda dayat\u0131lmas\u0131 ile, Anayasaya g\u00f6re \u00f6nerilmesi bile yap\u0131lamayacak olan laiklikten, demokratiklikten ve sosyal hukuk devlerinden s\u00f6z etmenin, \u00f6z\u00fcm\u00fcz\u00fc aldatmaktan \u00f6te bir anlam ta\u015f\u0131mad\u0131\u011f\u0131n\u0131 d\u00fc\u015f\u00fcnmekteyim.<\/div>\n<div dir=\"ltr\"><\/div>\n<div dir=\"ltr\">Bu ara notu d\u00fc\u015ft\u00fckten sonra gelelim 28 \u015eubat 1997 \u2018de ba\u015flay\u0131p, 2002\u2019den ba\u015flayarak mahkum edilen ve o g\u00fcn\u00fcn me\u015fru komuta kademesine kar\u015f\u0131 sergilenen kin ve nefrete neden olan s\u00fcrece\u2026<\/div>\n<div dir=\"ltr\"><\/div>\n<div dir=\"ltr\">\u201cPostmodern Darbe\u201d olarak da adland\u0131r\u0131lan 28 \u015eubat, Erbakan\u2019\u0131n Ba\u015fbakan, Tansu \u00c7iller&#8217;in D\u0131\u015fi\u015fleri \u00a0ve Ba\u015fbakan Yard\u0131mc\u0131s\u0131 oldu\u011fu 28 \u015eubat 1997&#8217;de yap\u0131lan Mill\u00ee G\u00fcvenlik Kurulu toplant\u0131s\u0131 sonucu a\u00e7\u0131klanan kararlarla\u201d gericili\u011fe kar\u015f\u0131 ba\u015flayan ordu ve b\u00fcrokrasi merkezli, Cumhurba\u015fkan\u0131 Demirel ve DYP Milletvekillerinden baz\u0131lar\u0131 destekli\u201d s\u00fcre\u00e7tir.
