Ba\u015flad\u0131\u011f\u0131 g\u00fcnden bu yana kamuoyunda tart\u0131\u015fmalara neden olan ve Mersin B\u00fcy\u00fck\u015fehir Belediye Ba\u015fkan\u0131 Vahap Se\u00e7er taraf\u0131ndan yarg\u0131ya ta\u015f\u0131nan projeyle ilgili s\u00fcre\u00e7 yeniden \u015fekilleniyor.<\/p>\n<p>Proje sahibi yap\u0131 kooperatifinin, in\u015faat\u0131 devam eden otele genel m\u00fcd\u00fcr atamas\u0131 yapmas\u0131yla birlikte sahadaki faaliyetler s\u00fcrerken, yarg\u0131 cephesinden gelen karar dengeleri de\u011fi\u015ftirdi.<\/p>\n<p>Dan\u0131\u015ftay 6. Dairesi\u2019nin, Mersin 2. \u0130dare Mahkemesi taraf\u0131ndan verilen karar\u0131 bozdu\u011fu ortaya \u00e7\u0131kt\u0131. Bozma gerek\u00e7esi olarak, bilirki\u015fi raporunda yer alan \u201ck\u0131y\u0131 kanununa ayk\u0131r\u0131l\u0131k\u201d tespiti ve mahkemenin eksik inceleme ile usul kurallar\u0131na tam riayet etmeden h\u00fck\u00fcm kurmas\u0131 g\u00f6sterildi.<\/p>\n<p>Y\u00fcksek mahkeme, dava konusu imar planlar\u0131n\u0131n; k\u0131y\u0131 mevzuat\u0131na, 3194 say\u0131l\u0131 \u0130mar Kanunu\u2019na, \u015fehircilik ilkelerine ve kamu yarar\u0131na uygun olup olmad\u0131\u011f\u0131n\u0131n yeterince ara\u015ft\u0131r\u0131lmad\u0131\u011f\u0131na h\u00fckmetti. Bu nedenle dosyada kapsaml\u0131 bir yeniden inceleme yap\u0131lmas\u0131n\u0131n \u00f6n\u00fcn\u00fc a\u00e7t\u0131.<\/p>\n<p><b>1 HAZ\u0130RAN&#8217;DA KR\u0130T\u0130K KE\u015e\u0130F<\/b><\/p>\n<p>Bozma karar\u0131n\u0131n ard\u0131ndan Mersin 2. \u0130dare Mahkemesi, 1 Haziran 2026 tarihinde b\u00f6lgede yeniden ke\u015fif ve bilirki\u015fi incelemesi yap\u0131lmas\u0131na karar verdi. Bu incelemede \u00f6zellikle \u015fu ba\u015fl\u0131klar mercek alt\u0131na al\u0131nacak:<\/p>\n<ul>\n<li>Tisan genelinde sahil \u015feridinde, mevzuat\u0131n \u00f6ng\u00f6rd\u00fc\u011f\u00fc anlamda ge\u00e7erli bir k\u0131smi yap\u0131la\u015fma olup olmad\u0131\u011f\u0131<\/li>\n<li>Projenin k\u0131y\u0131 mevzuat\u0131na uygunlu\u011fu<\/li>\n<li>\u0130mar planlar\u0131n\u0131n \u015fehircilik ilkeleri ve kamu yarar\u0131 a\u00e7\u0131s\u0131ndan de\u011ferlendirilmesi<\/li>\n<li>Otelin kat y\u00fcksekli\u011fi ba\u015fta olmak \u00fczere yap\u0131la\u015fma ko\u015fullar\u0131n\u0131n hukuka uygunlu\u011fu<\/li>\n<\/ul>\n<p>Yap\u0131lacak ke\u015fif ve haz\u0131rlanacak bilirki\u015fi raporu, projenin gelece\u011fini do\u011frudan etkileyecek. Mahkemenin verece\u011fi nihai karar\u0131n, hem b\u00f6lgedeki yap\u0131la\u015fma tart\u0131\u015fmalar\u0131na hem de benzer k\u0131y\u0131 projelerine emsal te\u015fkil etmesi bekleniyor.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Dan\u0131\u015ftay 6.
